Royal Caribbean Lawsuit Revived by Appeals Court

District Court Found No Notice of Risk

Atlanta, July 11 (Reuters) - A federal appeals court in Atlanta has revived a negligence lawsuit against Royal Caribbean Cruises Ltd., allowing a case to proceed that alleges the cruise line was negligent in the death of a passenger who fell overboard from a ship in 2019.

The 11th U.S. Circuit Court of Appeals overturned a lower court ruling that had dismissed the lawsuit, finding that the district court erred in finding that Royal Caribbean had no notice of the risk that a passenger could fall overboard from the ship's balcony. The appeals court found that there was evidence to support the plaintiffs' claim that Royal Caribbean had notice of the risk, including evidence that the company had received prior complaints about passengers falling overboard from its ships.
